
Hit-and-Run With No Police Report

Raynard: My name is Raynard Eubanks. I’ve been in a hit and run accident. I had to make a quick decision. I go behind to get the tag number or wait for the officer to come. I went behind them to get the tag number. I couldn’t get an attorney because I didn’t have no police report to go into the law firm. They listened to me because at first no one would listen to me because I didn’t have a police report.
Attorney Morgan Drapeau: He was on a complicated intersection for people familiar with Columbia, Marshall Street, over near the hospital and where you can turn. Other people are coming straight. And we believe she ran a red light which resulted in hitting the front of Mr. Eubanks vehicle, and she continued to drive away. He had to honk his horn, chase her down. They did finally pull into a hotel parking lot and she tried to deny that Mr. Eubanks was injured. She tried to deny that she hit him. And as Mr. Eubanks was calling for police, she left. He took her license plate down like he wanted to. And when he called the cops, they suggested that he do an FR-309 Report, which is something when somebody isn’t still at the scene so that the police wouldn’t come. And that’s what Mr. Eubanks did. But that’s also what ended up making his case a little bit more difficult. The most important thing that we can do as attorneys is to help people. And when Raynard came to us, he had had 4 or 5 different attorneys turn down his case simply because he didn’t have a police report. Both insurance companies — the at-fault driver’s and his own — had told him that they were no longer going to cover any of his medical bills. And so it was at that moment where we knew that he needed help and guidance, and that’s when we decided to take his case.
Raynard: It meant a lot to me to see that they cared enough just to listen to me. And I thank them for doing that.
