Usually, like most injury claims in the state of South Carolina, you have up to three years from the date of injury or death to file a case in our state courts. There can be some exceptions to that rule, however, in instances where a nursing home’s neglect is discovered after the actual injuries occurred, the three year clock starts on the discovery of the neglect and not the actual injury. This is important in cases where nursing homes try and cover up what truly happened to your loved ones. There can also be a shorter statute of only two years if the nursing home is run by the state.
