Columbia Hernia Lawyer

If you have suffered a hernia at work, Goings Law Firm, LLC can help you pursue a workers’ compensation claim. A hernia occurs when an internal organ or other body part protrudes or bulges through the wall of tissue or muscle normally containing it. Hernias commonly affect a person’s stomach or intestine. Hernias may be the result of any one of a number of common workplace activities. They can also be the result of activities outside the workplace, which is why proving a hernia in a workers’ compensation claim can often prove to be especially challenging.

When you have suffered a hernia on the job, the last thing that you want to deal with is difficulty obtaining workers’ compensation. Goings Law Firm, LLC handles workers’ compensation claims for hernia victims in Columbia and surrounding areas of South Carolina. Our firm has seen the kinds of issues that tend to arise in these types of cases and can help make sure that you avoid them. Our Columbia hernia lawyers can provide an honest and thorough evaluation of your case when you call (803) 350-9230 or complete an online contact form to schedule a free consultation.

Do I Need A Back Injury Lawyer?

People who are not prepared to provide certain kinds of evidence about their hernia may have their workers’ compensation claim denied. It can often be difficult to prove that your hernia was caused by the work you do at your job. Furthermore, medical evaluations and records may not be enough to prove the full extent of your pain and suffering. Additionally, failure to properly complete forms can lead to very lengthy delays that postpone your compensation, or cause it to be rejected altogether.

With a lawyer on your side, you are much more likely to receive the full amount of money you need when you need it. If your employer disputes that your hernia was work-related, your attorney can conduct an independent investigation to collect the necessary evidence to prove that it was. If your employer disputes that you truly require the amount of money you are requesting, your attorney can consult with experts to demonstrate that you do. Your attorney can also help you fill out your forms without any mistakes, ensuring that you receive your compensation as quickly and efficiently as possible.

Types of Hernia Cases We Handle

Some of the most common causes of hernias include heavy lifting and sharp blows to the abdomen. Workers who are exposed to conditions that involve any prolonged pressure on their abdomens may be more susceptible to hernias.

Many organs can herniate through certain orifices, so a complete list of all of the different types of hernias a person could suffer might be quite lengthy. In general, the five most common kinds of hernias include:

  • Inguinal Hernias — The most common kind of hernia. The inguinal canal is a passageway for the spermatic cord and blood vessels leading to the testicles in men, but contains the round ligament that gives support for the womb in women. Part of an intestine or fatty tissue will push through the inguinal canal in the groin area. Surgery is recommended when an inguinal hernia is painful or enlarging.
  • Femoral Hernias — Femoral hernias involve part of an intestine or fatty tissue passing into the femoral canal. A femoral hernia is similar to an inguinal hernia but is much less common and largely affects older females.
  • Umbilical Hernias — Umbilical hernias involve part of an intestine or fatty tissue passing the umbilical cord through the abdomen. The effects are felt near the belly button.
  • Incisional Hernias — Incisional hernias involve part of an intestine or fatty tissue protruding through the sites of surgical wounds that have not healed properly.
  • Diaphragmatic Hernias — Diaphragmatic hernias involve part of an intestine or fatty tissue protruding into the chest cavity through an opening in the diaphragm.

Hernias can be difficult workers’ compensation claims because many insurers will claim the injuries were preexisting or unrelated to work. Disputes about cause can be frustrating for people who often require surgery and cannot pay for it without their workers’ compensation.

Hernia Statistics

According to a study published in the Journal of the Royal Society of Medicine (JRSM) Short Reports, abdominal wall hernias occur in at least 2 percent of men, although some statistics estimate a rate of 15 per 1,000 population, or 1.5 percent. The JRSM study found that over 20 million hernias are repaired every year around the world, with approximately 700,000 repairs carried out in the United States.

A March 2015 study published in JAMA: The Journal of the American Medical Association found an estimated 2.3 million inpatient abdominal hernia repairs were performed between 2001 and 2010, an estimated 567 000 of which were performed emergently. The Asia Pacific Hernia Society reported that there is an extrapolated incidence of 539,807 inguinal hernias in the United States.
